Typographical Errors

Price & Promotion Changes

All prices and promotions listed on the Site are subject to change without notice. Only Natural Pet Store will need to modify prices from time to time and will not honor lower prices previously posted on the Site. Promotions are always of limited duration and their terms may change over time, and Only Natural Pet Store will not honor the terms of expired or modified promotions. Only one coupon code may be applied per order.

Term; Termination

These terms and conditions are applicable to you upon your accessing the Site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Only Natural Pet Store without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Miscellaneous

Your use of the Site shall be governed in all respects by the laws of the state of Colorado, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to the Site (including but not limited to the purchase of Only Natural Pet Store products) shall be in the state or federal courts located in Boulder County, Colorado. Any cause of action or claim you may have with respect to the Site (including but not limited to the purchase of Only Natural Pet Store products) must be commenced within one (1) year after the claim or cause of action arises. Only Natural Pet Store's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Only Natural Pet Store may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site

Harassment in any manner or form on the Site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Only Natural Pet Store or other licensed employee, host, or representative, as well as other members or visitors on the Site is prohibited. You may not upload to, distribute, or otherwise publish through the Site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. Only Natural Pet Auto Delivery Program Terms & Conditions

The Only Natural Pet Auto Delivery Program (the “Auto Delivery Program”) is governed by these Terms & Conditions (these “Auto Delivery Terms”), as well as the Only Natural Pet Terms of Use (the “Terms of Use”) and the Only Natural Pet Privacy Policy (the “Privacy Policy”), all of which (as changed over time) are incorporated into these Auto Delivery Terms, and constitute your entire agreement with ONP-EComm, LLC (“Only Natural Pet”) relating to the Auto Delivery Program.

ARBITRATION NOTICE: THE TERMS OF USE WHICH GOVERN THE AUTO DELIVERY PROGRAM CONTAIN BOTH A MANDATORY INDIVIDUAL ARBITRATION PROVISION AND A CLASS ACTION/JURY TRIAL WAIVER PROVISION. THESE PROVISIONS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS. BY PLACING AN ORDER AND ENROLLING IN THE AUTO DELIVERY PROGRAM, YOU ACCEPT THESE AUTO DELIVERY TERMS AND EXPRESSLY AGREE TO BE BOUND BY AND ABIDE BY THESE AUTO DELIVERY TERMS, THE PRIVACY POLICY, AND THE TERMS OF USE, INCLUDING THE MANDATORY INDIVIDUAL ARBITRATION PROVISION. Joining the Auto Delivery Program

Subject to these Auto Delivery Terms, when you join or enroll in the Auto Delivery Program, you are agreeing to and signing up to receive continuous shipments of items at a frequency of your choosing.

To join the Auto Delivery Program, you will need an Only Natural Pet account. To create an account, follow the instructions on the Only Natural Pet website. Creating an Only Natural Pet account will automatically enroll you in Only Natural Pet’s Loyalty Rewards program (your rebates are governed by the Rewards Program Terms and Conditions). Only the person who is the authorized e-mail account holder of the e-mail address linked to the Only Natural Pet account may enroll in the Auto Delivery Program. The Auto Delivery Program is only available in the United States. YOU MAY NOT ACCESS, USE, PLACE AN ORDER, OR ENROLL IN THE AUTO DELIVERY PROGRAM UNLESS YOU ARE AT LEAST 18 YEARS OLD.

Benefits of the Auto Delivery Program

When applicable to your purchase (as designated on the Only Natural Pet website), you will receive the benefit of an Auto Delivery discount on your initial and/or future Auto Delivery orders. Special limited time Auto Delivery promotions only apply during their effective dates. Notwithstanding any of the foregoing, Only Natural Pet reserves the right to change the Auto Delivery benefits at any time in its sole discretion, including discount amounts, promotions, and eligibility. In addition, some of the offer details may change as you receive deliveries over time (for example item price, taxes, availability, and/or shipping charges); provided however, Only Natural Pet will not change the price of an item or a discount on your next order once you have received an order confirmation email for that order.

Further, the Auto Delivery program has various promotions, discounts and limit that include limit to one subcriber per household ($35 max usage), one use of the new customer offer per year per household and maximum of 5 units per any single item per shipment. Order exceeding these limits may be canceled without notice. 

Order Process

After joining the Auto Delivery Program, your first order will be processed immediately and the payment method you have provided will be charged at the time the order is placed.

Thereafter Only Natural Pet will place your Auto Delivery orders automatically according to your selected frequency. Subject to these Auto Delivery Terms, this will continue until you cancel your enrollment in the Auto Delivery Program. Auto Delivery items that have the same order date, shipping address, billing address, and payment method will ship as one order.

With respect to future orders, Only Natural Pet will send you a reminder email. You can skip, edit, or cancel your order up to twenty-four (24) hours prior to the order’s placement date specified in such email. If you do not cancel an order before the day prior to its placement date, your order will be authorized and you will be charged as further described in the “Credit Card Authorizations and Charges” section below. You will also receive an order confirmation email and a shipment confirmation email. Your order’s delivery date depends on when an order leaves the distribution center, the destination address, and the shipping method.

The Auto Delivery Program is a subscription program that is contingent upon item availability; no substitutions will be made. You will receive an email notification if one or more of your items is not available.

When applicable to your purchase, Loyalty Rewards Rebates will be accrued on however, those rebates won't automatically apply to your Auto Delivery orders, but can be used for other purchases during our 4 annual rebate period(s), further Rewards Rebates cannot be used towards the payment of sales tax or shipping and handling.

Credit Card Authorizations and Charges

By enrolling in the Auto Delivery Program, you expressly permit Only Natural Pet to charge your provided payment method on a recurring basis, as well as the amount of the charge, all at the frequency and quantity you selected. As such, Only Natural Pet will submit periodic charges to your provided payment method without further authorization from you, until you provide notice otherwise. Such notice and/or any changes to your payment method will apply to an order if it is made at least twenty-four (24) hours prior to that order’s placement date.

On your order’s placement date, your order will be automatically authorized (i.e., some debit and bank check cards may reflect a deduction of funds at such time; this however is an authorization only). The amount you are to be charged for your item(s) will be the price of the item(s), plus any applicable sales tax (taxes are finalized when your order ships), and in some cases, shipping charges. 

If Only Natural Pet is unable to complete your Auto Delivery order with your payment method, we have the right to cancel your order. Only Natural Pet, at its discretion, may email you a notification and the opportunity to charge another payment method and update your payment information in your Only Natural Pet account prior to such cancellation.

All Auto Delivery orders require a credit or debit card payment. You will be required to add a credit or debit card payment method to your Only Natural Pet account prior to purchasing any item pursuant to the Auto Delivery Program. Alternative payment forms, such as PayPal and gift cards, cannot be accepted at this time.

Making Changes to an Auto Delivery Order and Your Account

By visiting the Auto Delivery section of your Only Natural Pet account or following the link in your order confirmation email, you can change your shipping address, payment method, and other account information. You can also add to an order, skip an order, change your order frequency, or cancel your enrollment in the Auto Delivery Program. Please allow up to 24 hours for modifications to be processed. All changes made to your Only Natural Pet account or an order are subject to these Auto Delivery Terms (e.g., you cannot make any changes to an order less than 24 hours prior to the order’s placement date).

Cancellation and Reactivation

Your Auto Delivery subscription will remain in effect until it is cancelled. You can cancel at any time by visiting the “Auto Delivery” tab in your Only Natural Pet account and selecting the “Cancel Subscription” link. Such cancellation will not affect orders placed within twenty-four (24) hours of your cancellation.

If you cancel your Auto Delivery subscription and then reactivate or resume it, the Auto Delivery discount, if any, may not be the same discount you were receiving at the time of cancellation. Accordingly, the new price will be applied to your future orders.

Notifications

From time-to-time, you may receive email notifications and other important information related to your Only Natural Pet account and the Auto Delivery Program, such as, if your item is discontinued or out of stock, if you cancel your enrollment, or if your payment method fails.

Miscellaneous Terms

Only Natural Pet may, in its sole discretion, terminate your Auto Delivery subscription and/or the Auto Delivery Program at any time without notice to you. If Only Natural Pet does so, you will only be charged for orders that (a) have shipped to you, and (b) are already placed and will actually ship to you.

Only Natural Pet shall not be liable to you for any breach of its obligations under these Auto Delivery Terms arising from causes beyond its reasonable control, including, but not limited to, weather, fires, floods, earthquakes, and other acts of God, pandemics/epidemics, acts of terrorism, acts of war, strikes, delays caused by third-party transportation, embargoes or industrial disturbances, power outages, shutdowns, or local, state or federal governmental actions.

Your participation in the Auto Delivery Program is personal to you, and you may not assign or transfer your subscription or any of the benefits to any third party without express written authorization from Only Natural Pet. Further, other retailers or resellers are specifically prohibited from participation in the Auto Delivery Program or Loyalty Rewards Program - orders are subject to cancel without notice. All returns under the Auto Delivery Program are subject to Only Natural Pet’s Return Policy (as changed over time). Auto Delivery subscriptions are void where prohibited.

Only Natural Pet offers its customers mobile alerts regarding promotions, sales, offers, alerts, and cart reminders by SMS message (the "Service") on 53656. By participating in the Service, you are agreeing to these Terms and to the Privacy Policy

Signing Up and Opting-in to the Service

Enrollment in the Service requires you to provide your mobile phone number and to agree to these terms and conditions. You may not enroll if you are under 18 years old. Before the Service  will start, you will need to agree to these Terms. Only Natural Pet reserves the right to stop offering the Service at any time with or without notice.

By opting into the Service, you:

 

• A. Authorize Only Natural Pet to send recurring automated text messages to the mobile phone number associated with your opt-in (i.e., the number listed on the opt-in form or, if none, the number from which you send the opt-in, or, if none, the number on file for the account associated with your opt-in).
• B. Acknowledge that you do not have to agree to receive messages as a condition of purchase.
• C. Confirm that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and that you are authorized to opt in.
• D. Consent to the use of an electronic record to document  your opt-in. To request a free paper or email copy of the opt-in or to update our records with your contact information, email service@onlynaturalpet.com. To view and retain an electronic copy of these Terms or the rest of your opt-in, you will need (i) a device (such as a computer or mobile phone) with Internet access, and (ii) and either a printer or storage space on such device. For an email copy, you'll also need an email account you can access from the device, along with a browser or other software that can display the emails.

Once you affirm your choice to opt-in to the Service on 53656, your message frequency may vary. You may receive alerts about:

Charges & Carriers

Message and data rates may apply. Please consult your service agreement with your wireless carrier or contact your wireless carrier to determine your phone's pricing plan and the charges for sending and receiving text messages. You acknowledge that you are responsible for any message, data or other charges incurred (usage, subscription, etc.) as a result of using the Service.

Supported carriers are AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Virgin Mobile, U.S. Cellular, Cricket, Alltel, Cincinnati Bell, Cellcom, C-Spire, nTelos, MetroPCS, and other smaller regional carriers. The Service may not be available on all wireless carriers. Only Natural Pet may add or remove any wireless carrier from the Service at any time without notice. Only Natural Pet and mobile carriers are not responsible for any undue delays, failure of delivery, or errors in messages.

To Stop the Service

To stop receiving text messages from Only Natural Pet, text the word STOP to 53656 any time or reply STOP to any of the text messages you have received from Only Natural Pet. This is the exclusive method for opting out. After texting STOP to 53656, you will receive one additional message confirming that your request has been processed.

Changes to Terms

These Mobile Terms and Conditions are subject to change at any time without notice.

Arbitration and Class Action Waiver

Please read this carefully. It affects your rights. Any dispute or claim relating in any way to your use of Only Natural Pet will be resolved by binding arbitration, rather than court.

This agreement to arbitrate is intended to be broadly interpreted, and expressly includes claims brought under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq., or any other statute, regulation, or legal or equitable theory.  You and Only Natural Pet hereby agree that the Federal Arbitration Act, 9 U.S.C. 1, et seq. (“FAA”) applies to this agreement to arbitrate, and governs all questions of whether a dispute is subject to arbitration.  Unless you and we agree otherwise in writing, arbitration shall be administered by the American Arbitration Association’s Consumer Arbitration Rules in effect at the time of filing of the arbitration (the “AAA’s Rules”).  However, just as a court would, the arbitrator or arbitrators must honor the terms and limitations in this Agreement, and can award damages and relief (including any attorneys’ fees) authorized by law and/or the AAA’s Rules.  The arbitration decision and award is final and binding, with some exceptions under the FAA, and judgment on the award may be entered in any court of competent jurisdiction. YOU AGREE THAT, BY ENTERING INTO THIS AGREEMENT, YOU AND ONLY NATURAL PET ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING.

THIS AGREEMENT DOES NOT ALLOW FOR CLASS ARBITRATIONS EVEN IF THE PROCEDURES OR RULES OF THE AAA WOULD.  RATHER, YOU AND WE ARE ONLY ENTITLED TO PURSUE ARBITRATION ON AN INDIVIDUAL, BILATERAL BASIS.  FURTHER, AND UNLESS YOU AND ONLY NATURAL PET AGREE OTHERWISE IN WRITING, THE ARBITRATOR(S) MAY NOT CONSOLIDATE MORE THAN ONE INDIVIDUAL PARTY’S CLAIMS WITH ANY OTHER PARTY’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR COLLECTIVE PROCEEDING.

You and Only Natural Pet are each responsible for our respective costs relating to counsel, experts, and witnesses, as well as any other costs relating to the arbitration.  Only Natural Pet however, will pay for the arbitration administrative or filing fees, including the arbitrator and/or other AAA case management fees, for any claim seeking $75,000 or less, unless the claim is determined by the arbitrator to be frivolous.  Otherwise, the AAA’s Rules regarding costs and payment apply.
This agreement to arbitrate does not preclude you from bringing issues to the attention of federal, state, or local agencies. Such agencies can, if the law allows, seek relief against us on your behalf.

If any term of this Section (Arbitration and Class Action Waiver) is to any extent illegal, otherwise invalid, or incapable of being enforced, such term shall be excluded to the extent of such invalidity or unenforceability; all other terms hereof shall remain in full force and effect; and, to the extent permitted and possible, the invalid or unenforceable term shall be deemed replaced by a term that is valid and enforceable and that comes closest to expressing the intention of such invalid or unenforceable term.  If application of this Severability provision should materially and adversely affect the economic substance of the transactions contemplated hereby, the Party adversely impacted shall be entitled to compensation for such adverse impact, provided the reason for the invalidity or unenforceability of a term is not due to serious misconduct by the Party seeking such compensation.
